Terms and Conditions

Understanding 

  1. The terms and conditions below apply to all professional development services and research consultancy provided by ALPHASTUTE LLC (“AA”) to any individual or organization ("the client") and constitute the contract for the service to be provided by AA for the client. The term 'professional development service' as here used covers career coaching, business coaching further education coaching and where applicable includes mentoring or supervision services provided for clients, coaches or others.
  2. The client understands that all coaching sessions are available for booking between the hours of 10AM to 4PM EST on Mondays, Tuesdays, Wednesdays and Thursdays. No coaching sessions are available on Fridays, Saturdays or Sundays.
  3. The Client understands that they must book all of their sessions within 7 days of purchase of the Beyond The Peak coaching container. 
  4. Alphastute will endeavour to ensure adequate availability is made available for the client to book and where there is a mutually convenient date on the client coaching dashboard Alphastute will find a mutually convenient date within the stated schedule.
  5. If the Client fails to book all their sessions 50% of their payment will be refunded within 3-5 business days and service delivery withdrawn by Alphastute. 
  6. Coaching is not psychological counselling or any type of therapy and should not be used as a replacement for the appropriate work with a healthcare professional.
  7. AA agrees to provide the service as described below and in accordance with the terms and conditions set out below.
  8. AA will seek to enable the client to set and achieve goals that will help to bring about desired outcomes for the client. The client has sole responsibility for any decisions they may make following coaching with AA. AA accepts no liability for the client’s actions. AA has no liability for any loss incurred by any client, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by the client, whether justified or otherwise, to achieve a material improvement in quality of life  or to achieve their desired outcomes or goals.

Confidentiality 

  1. Reasons for activating coaching with AA and/or personal circumstances will be treated as confidential. It will not be disclosed to a third party without the client's prior permission, save where required by law.
  2. AA’s business model is framed on Client success and as such, AA reserves the right to celebrate the success of all of its Clients via its social media platforms for advertising and prospective client recruitment, respecting anonymity where requested.
  3. All documentary outputs delivered by AA under Beyond The Peak are the property of AA.
  4. Client confidential information shall not include material created by Client on internet social media (including, but not limited to, Facebook, LinkedIn, Twitter and Instagram). Where such material on social media mentions AA, services provided by AA, AA staff or Programs then Client consents to AA using such material for marketing and similar purposes without express permission of Client and that Client will have no claim of any kind against AA for use of the material.

 No Transfer of Intellectual Property

  1. AA’s copyrighted and original materials shall be provided to the Client for his/her individual use only and with a single-user, non-transferable, revocable license.
  2. Both Client and AA agree that he/she will not use each other’s intellectual property, including without limitation the AA’s copyrighted and original materials, for Client’s business purposes.
  3. Client shall not be authorized to share, copy, distribute, or otherwise disseminate any materials received from AA electronically or otherwise without the prior written consent of AA.

Fees 

  1. Client agrees to pay fees to AA for the selected Beyond The Peak coaching package. Failure to pay agreed fees in accordance with coaching payment plan selected at time of purchase will result in coaching services being paused or withdrawn and all payments made forfeited.

Reschedules, Cancellation, Termination and Refunds

  1. If the client needs to reschedule a coaching session, they must provide at least 48 hours’ notice. In exceptional circumstances AA may need to reschedule a coaching session; in these circumstances AA will use reasonable endeavors to provide a mutually satisfactory alternative appointment for the client.
  2. Clients are allowed a maximum of one reschedule a month. AA will not be responsible for loss of sessions within the coaching duration due to the rescheduling of the Client. Client must ensure they are present and available to get the most out of their coaching duration. 
  3. Missed sessions will not be made up within the coaching duration. The client has the opportunity to reschedule the session within the coaching duration but sessions missed cannot be made up outside of the coaching duration due to unavailability of the Coach.
  4. The client or AA may terminate this coaching contract at their discretion but the party must give 14 days notice in writing.
  5. Due to the nature of 1-1 coaching and the extensive preparation and clearance of schedules to accommodate a client’s coaching journey, payments are non-refundable.

 

By purchasing the Beyond The Peak the client understand and agrees to the above Terms and Conditions.Â
